Article 1: Purpose


The present terms of sale aim to define the terms of distance selling between SARL V.M.B.C. and the INTERNET USER, from the order, payment, to delivery. They regulate all the necessary steps for placing the order and ensure the follow-up of this order between the contracting parties.

At the time of the order, the INTERNET USER acknowledges having read the general terms and conditions of sale stated below and declares to accept them without reservation. The validation of the order constitutes irrevocable acceptance of the General Terms and Conditions of Sale.

1.1 Only persons of legal age (eighteen years), having the legal capacity to enter into contracts, and (c) residing in metropolitan France, Belgium, or Luxembourg can order Products through the Customer Service or on the Website. If you have not reached the age of majority or if for any other reason you do not have the legal capacity to enter into contracts, one of your parents or your guardian must place your order on your behalf, thus approving these General Terms and Conditions of Sale. Any order placed in violation of this article will be considered null and void.

1.2 SARL V.M.B.C. sells products on montblanc-boutique-cannes.com and conducts its own e-commerce activity exclusively towards end users who are final consumers.
By "final consumer(s)", we mean any natural person acting for purposes unrelated to any business or professional activity possibly practiced. If you are not a "final consumer", we invite you to refrain from concluding commercial transactions on montblanc-boutique-cannes.com
By placing an order through the Customer Service or on the Website, you declare and guarantee that you are a bona fide end customer and that you will not deliver, sell, or distribute in any other way Montblanc Products, nor will you purchase Montblanc Products for commercial purposes or for any commercial reason.
In light of the commercial policy described above, SARL V.M.B.C. reserves the right not to process orders from anyone who is not a "final consumer" or a legal adult, for example if SARL V.M.B.C. has reason to believe that an order was placed in violation of its commercial policy and these General Terms and Conditions of Sale

Article 2: Offer

 

2.1 On montblanc-boutique-cannes.com, the products offered for sale are those listed on the site at the time of its consultation by the USER. We exclusively offer items bearing the Montblanc brand. We source our stocks directly from the Montblanc house. They are offered on our site within the limits of available stock.
2.2  The Montblanc brand does not sell second-hand, defective, or inferior quality products below market standards.

 

2.3 The essential characteristics of the products are presented on montblanc-boutique-cannes.com in the descriptions of each product sheet. The images and colors of the products sold on montblanc-boutique-cannes.com may, however, not correspond to the actual colors due to the internet browser and the screen used by the USER.

All items sold on montblanc-boutique-cannes.com are covered by a twenty-four (24) month warranty in case of conformity defects, as provided by the applicable legislation. The USER must inform SARL V.M.B.C. of the existence of a conformity defect within two (2) months from the day you noticed said conformity defect.

Please contact our Customer Service.

If an item has a conformity defect, you can either have it repaired or replaced. If these solutions are impossible to implement or seem disproportionate, you may ask SARL V.M.B.C. to apply an appropriate reduction on the purchase price or demand a cancellation of the order.


Article 3: Pricing

3.1 SARL V.M.B.C. applies the recommended retail price set by MONTBLANC.
Prices are presented in EUROS including VAT (all taxes included), excluding delivery charges which remain the responsibility of the USER, unless otherwise stated or specified.


3.2 Products are billed based on the rates in effect at the time of order registration. Product prices are therefore regularly updated. The USER is invited to check the final selling price before finalizing their order.

 

3.3 Orders that need to be delivered to addresses located in countries not included in our delivery zones may not be accepted (See Article 6: Conditions and delivery times – shipping costs)



Article 4: Payment


4.1 Payment can be made by bank transfer through the online payment system of our partner Stripe, provided that it reaches us within 3 working days following the validation of the order. The bank details will be sent upon confirmation of the order. The order is only unlocked after the actual receipt of the transfer by our bank. For any information regarding the security of online payments, please refer to Article 5 below.

As part of the fight against credit card fraud, SARL V.M.B.C. reserves the right to verify the personal data provided by the customer and to take any necessary measures to ensure that the person whose bank account is debited is indeed the one who placed the order, and to prevent any fraudulent use of credit card numbers.

In this context, the customer will undergo a 3-D Secure verification during the purchase, the secure online payment protocol, which will allow them to confirm the ownership of their VISA or MASTERCARD credit card.
 
4.2 Payment can also be made by bank check, which must be issued by a bank located in metropolitan France and made out to SARL V.M.B.C. MONTBLANC CANNES. It must be made out in the name, first name, and address of the Customer who placed the order on the site. Otherwise, SARL reserves the right to refuse any non-compliant check and will cancel the order.


The check must arrive within 3 working days following the validation of the order at the following address:

The order is only unlocked after the expiration of the bank unavailability period, which is 21 days after its actual cashing.

4.3 Payment can be made via Paypal.
The invoice related to the order is sent to the USER's email inbox.

 

4.4 Payments in installments are made through Alma.
  • The credit service from Alma is offered for the payment of purchases and the execution of payment, provided that the person purchasing the good or service through Alma ("Buyer") accepts the installment payment contract or the deferred payment contract.
  • Fees may be charged by Alma.
  • Any refusal to grant the installment payment or deferred payment by Alma may result in the cancellation of the purchase contract for the good or service ("Terms and Conditions") unless the Buyer agrees to pay the full amount of the purchase in cash.
  • In the event of termination of the Terms and Conditions, the installment payment or deferred payment contract will be automatically terminated.
  • In the event of withdrawal from the installment payment or deferred payment solution used for your payment, the Terms and Conditions will be automatically terminated, unless you pay the full amount of your purchase in cash through Alma. If the product has already been shipped to you, you must return it within the maximum time frame provided in these Terms and Conditions.

Payment in 3 or 4 installments:

. Payment in three / four installments is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

. Only purchases between €100 and €9000 are eligible for payment in three or four installments with Alma.

. Fees: By paying in three / four installments with Alma, the Client does not incur any fees.

. Alma is a telepayment manager and issues an electronic certificate that serves as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 and following of the civil code.

. Termination: Any termination of the Terms and Conditions binding the Seller and the client results in the termination of the General Terms of Use between Alma and the client.

Credit x10 with Alma:

. The amount is partly paid by credit granted by Alma SAS, a payment institution and financing company approved by the ACPR under number 17408 - CIB code.

. Only purchases between €850 and €9000 are eligible for credit x10 with Alma.

. Fees: by choosing this payment method, Alma will charge additional fees to the Client who becomes a borrower.

. In accordance with article L.312-50 of the Consumer Code, in the case of payment in installments, including the payment of a deposit, a receipt will be provided to the buyer on paper or any other durable medium serving as a receipt and containing the full reproduction of the provisions below (articles L. 312-52, L. 312-53 and L. 341-10 of the Consumer Code):

    • Article L312-52: The sale or service provision contract is automatically resolved, without compensation:
      • 1° If the lender has not, within seven days from the acceptance of the credit contract by the borrower, informed the seller of the allocation of the credit;
      • 2° Or if the borrower has exercised their right of withdrawal within the time frame provided in article L. 312-19.
      • However, when the borrower, by an express request, solicits the immediate delivery or provision of the good or service, the exercise of the right of withdrawal from the credit contract does not automatically lead to the resolution of the sales or service contract unless it occurs within three days from the acceptance of the credit contract by the borrower. The contract is not resolved if, before the expiration of the deadlines mentioned in this article, the buyer pays in cash.
  • Article L312-53: In cases of resolution of the sales or service contracts provided for in Article L. 312-52, the seller or service provider shall refund, upon simple request, any amount that the buyer would have paid in advance on the price.
  • Article L341-10: In cases of resolution of the sales or service contracts provided for in Article L. 312-53, starting from the eighth day following the request for reimbursement of any amount paid in advance by the buyer, this amount shall accrue interest, by operation of law, at the legal interest rate increased by half.

The credit is granted by the company Alma, a company with a capital of €316,226.83, RCS Nanterre 839 100 757, authorized by the ACPR under No. 090789 - Contact: support@getalma.eu. SARL V.M.B.C. is a credit indicator in accordance with the provisions of R.519-2, 1° of the Monetary and Financial Code. The company SARL V.M.B.C. disseminates the advertisements sent by Alma related to the granting of credit by Alma.

 

If you pay for your order via an Alma payment solution, you accept the general customer terms of Alma. as well as the specific Alma terms for VMBC Montblanc Cannes customers.

Article 5: Security of online payments
Payment is fully secured on our site thanks to the online payment system of our partner Stripe, a PCI/DSS Level 1 certified payment solution (the highest level of security for online payments). The credit card information you enter on our site is encrypted and never transmitted in clear text over the Internet. Furthermore, it is only processed by Stripe and is never in our possession. When you enter your card number to make purchases on our site, you are transmitting it to Stripe, not to SARL V.M.B.C. Stripe is continuously committed to using the data only for the limited purposes described in their privacy policy (see below)

The USER must enter their credit card number as well as its expiration date. During the various exchanges between the USER's PC and the payment server, the data is never transmitted in clear text over the network but is encrypted using the SSL protocol. The entered data thus remains confidential; it is automatically encrypted and communicated directly to the Bank. 

To combat fraud, you will be redirected to the 3D Secure verification page during payment. A confidential code will be sent via text message to your mobile number; this code will be necessary to confirm that you are the owner of the payment card and to finalize your order.
The payment of the USER will only be validated after verification of stock and/or delivery time.
 
SARL V.M.B.C. reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially settled a previous order, or with whom a payment dispute is ongoing.
SARL V.M.B.C. reserves the right not to accept an order from a dubious or unidentifiable source.
 
Article 6: Delivery Conditions and Times – Shipping Costs


1.      Delivery in metropolitan France + Monaco:
.         Colissimo Followed 48-72H from dispatch from Monday to Saturday for refills and ink cartridges, as well as other small-sized products: €6.90 for a cart amounting to less than €100 including VAT
.         Colissimo Followed 48-72H: Free for orders over €100 including VAT
·        Chronopost 24H from dispatch from Monday to Saturday: €9.90
 
2.      Delivery in Belgium:
·         Chronopost express International: 24H to 48H from the date of shipment               from Monday to Saturday: 9.90 €


3.      Delivery to Switzerland:

·         Chronopost express International: 24H to 48H from the date of shipment               from Monday to Saturday: 19.90 €


4.      Delivery to the Netherlands:

·         Chronopost express International: 24H to 48H from the date of shipment               from Monday to Saturday: 25 €


5.      International delivery:

·         Chronopost express International: 24H to 48H from the date of shipment               from Monday to Saturday: 45 €
 
6.      General provisions:

Orders validated before 1 PM from Monday to Friday will be shipped on the same day. After that, they will be shipped on the next working day.

The delivery times above are based on the date of shipment of the goods. Saturdays, Sundays, and public holidays (including those specific to Alsace Moselle) must be added to the initial delivery time.
The responsibility of SARL V.M.B.C. cannot be engaged in case of delivery delay, for any reason whatsoever. According to legal provisions, in case of delivery delay of more than 7 days, you have the option to cancel your order within 60 working days. If applicable, if the product is delivered after cancellation, we will proceed to refund the product and shipping costs; this upon receipt of the product by us and in its original condition, the package must not have been opened. Please note, however, that in the context of returning the package, return shipping costs are to be borne by L'INTERNAUTE.
 
Upon receipt of your package, it is imperative to check the general condition of the package.

L'INTERNAUTE must notify the Carrier and SARL V.M.B.C. of all reservations on the delivered products (for example: damaged package, already opened, etc.). If the products were damaged, we advise you to refuse delivery. If applicable, L'INTERNAUTE must inform SARL V.M.B.C. in writing within a maximum of 48H from the refusal.



Article 7: Withdrawal and return procedures
In accordance with the applicable legislation, you benefit from a withdrawal period of 14 days from the date of receipt of the package to retract from your order.
The INTERNET USER may contact SARL V.M.B.C. to obtain a return agreement. The return costs remain the responsibility of the INTERNET USER who will ensure its shipment, as SARL cannot be held responsible in case of loss or theft.

After this 14-day withdrawal period, the delivered products will be deemed compliant and accepted by the customer, and SARL V.M.B.C. reserves the right to refuse exchange, refund, or credit.
 
Exception to the right of withdrawal:
The exercise of the right of withdrawal is excluded for the following contracts:
-  contracts for the supply of goods that have been unsealed by the consumer after delivery and that cannot be returned for reasons of hygiene or health protection.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous declaration (for example, a letter sent by post or an email) sent by post to the address SARL V.M.B.C. 87 Rue d'Antibes, 06400 Cannes, by phone at +33 4 97 06 16 66 or by Email at the address boutique@montblanc-cannes.com. You may use the model withdrawal form but this is not mandatory.
To ensure that the withdrawal period is respected, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the expiration of the withdrawal period.
WARNING: In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal is excluded if you have purchased personalized products or in the case of sealed items that have been opened after delivery and that cannot be returned for health or hygiene reasons.
 
Article 8: Protection of personal data
Providing personal information collected as part of distance selling is mandatory, as this information is necessary for processing and delivering orders as well as for issuing invoices. This information is strictly confidential and is intended only for SARL V.M.B.C.

In accordance with law no. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, the processing of personal information collected on the site has been the subject of a declaration to the National Commission for Information Technology and Civil Liberties. The USER has the right to access, modify, rectify, and delete data concerning them. To exercise this right, the USER must contact SARL V.M.B.C. by email or by sending a letter to the following address: SARL V.M.B.C. - 87 Rue d'Antibes, 06400 Cannes.

Article 9: Responsibility
Any input error regarding prices, availability, or labels is independent of the will of SARL V.M.B.C. If necessary, the USER will be notified as soon as possible by email or by phone, and the order will only be definitively validated after their agreement.

SARL V.M.B.C. is subject to a simple obligation of means regarding all stages of access to the site, the ordering process, delivery, or subsequent services. The responsibility of SARL V.M.B.C. cannot be validly sought in the event of damage resulting from the use of the internet, particularly the presence of an external virus.
Furthermore, SARL V.M.B.C. cannot be held responsible in cases of force majeure or fortuitous events that prevent the proper execution of orders, particularly in the event of a strike by postal services.

 

Article 10: Modification and update

The General Terms and Conditions of Sale are regularly modified, particularly in consideration of potential regulatory changes. The new General Terms and Conditions of Sale will apply from their publication date* on montblanc-boutique-cannes.com.
